What “No State License Required” Actually Means
The absence of a state licensing scheme in Colorado does not mean private investigation is unregulated. It means there is no centralized state board issuing or revoking PI credentials. Operators must still comply with federal law (Fair Credit Reporting Act for background reports, federal wiretap statutes for audio interception, the Driver’s Privacy Protection Act for DMV-record access) and with state and local laws covering trespass, harassment, recording consent, and the unauthorized practice of law.
What to Verify When Hiring in Colorado
Without a state license to confirm, due diligence falls on the client. Before retaining an investigator in Colorado: confirm a valid business registration, ask for proof of professional liability insurance, request references from attorneys or insurers who have used the firm, and check for affiliation with national associations such as the National Council of Investigation and Security Services or the Council of International Investigators. Local municipal registration (where required) is a useful additional verification.
